1. ACCEPTANCE OF TERMS
By creating an account or using Loylar, you agree to these Terms & Conditions. If you do not agree, do not use the service.
2. DESCRIPTION OF SERVICE
Loylar is a customer retention and loyalty management platform designed for Indian offline retailers including salons, spas, gyms, restaurants, and clinics.
3. ELIGIBILITY
- Must be 18 years or older
- Must be operating a legitimate business in India
- One account per business (additional locations on Growth/Pro plans)
- Accurate business information required
4. ACCOUNT RESPONSIBILITIES
- Keep login credentials secure
- You are responsible for all activity under your account
- Notify us immediately of unauthorized access
- Provide accurate business information
5. ACCEPTABLE USE
You agree NOT to:
- Use Loylar for illegal purposes
- Send spam or unsolicited messages
- Upload false customer data
- Misrepresent your business
- Attempt to reverse-engineer the platform
- Share your account with unauthorized persons
- Use the service to harass or harm customers
6. WHATSAPP USAGE POLICY
- You must comply with WhatsApp's Terms of Service
- Personal WhatsApp campaigns must be sent manually by you — not through automation
- Business API usage must comply with Meta's policies and your provider's terms
- Loylar is not responsible for WhatsApp account restrictions due to policy violations
7. CUSTOMER DATA & CONSENT
- You represent that you have lawful basis to store your customers' contact information
- You are responsible for obtaining appropriate consent from customers for marketing messages
- You must honor opt-out requests from customers
- Loylar's processing of your customers' data is governed by our Privacy Policy
8. SUBSCRIPTION AND PAYMENT
- Plans billed monthly in advance
- Payment due by the 1st of each month
- Accounts suspended after 15 days of non-payment
- Accounts deleted after 45 days of non-payment
- No refunds for partial months
- Price changes notified 30 days in advance
- All prices in Indian Rupees (₹) inclusive of GST
9. FREE TRIAL
- 14-day free trial with Starter plan features
- Credit card not required for trial
- Trial can be extended by Loylar at its discretion
- Loylar reserves the right to deny trial access
10. INTELLECTUAL PROPERTY
- Loylar platform, code, and content owned by Loylar Technologies
- Your business data and customer data belongs to you
- You grant Loylar license to process your data to provide the service
- AI-generated insights are provided as-is
11. SERVICE AVAILABILITY
We target 99% uptime but do not guarantee it. Maintenance windows are notified in advance when possible. Loylar is not liable for losses due to downtime.
12. LIMITATION OF LIABILITY
- Loylar liability limited to 3 months of subscription fees paid
- No liability for indirect or consequential damages
- No liability for actions taken based on AI insights
- No liability for WhatsApp policy changes
13. TERMINATION
- You may cancel anytime from Settings → Billing
- Loylar may terminate accounts for Terms violations
- Data available for 30 days after termination
- Loylar may terminate accounts pending approval
14. GOVERNING LAW
- These terms governed by Indian law
- Disputes subject to jurisdiction of courts in Delhi, India
- Parties will attempt mediation before litigation
15. CHANGES TO TERMS
Material changes will be notified by email 15 days prior to taking effect. Continued use of the service after changes constitutes acceptance.
